Description
The Commercial and Conveyancing Lawyer will manage a broad
range of legal responsibilities, including handling commercial transactions,
property conveyancing, and providing legal support for banking operations. This
role demands familiarity with Kenyan property laws, financial regulations, and
compliance frameworks. The ideal candidate will bring practical experience in
drafting, reviewing, and negotiating legal documents related to both commercial
and property matters, with an emphasis on banking and financial services.
Requirements
- Education:
- Bachelor
      of Laws (LLB) degree from a recognised university in Kenya.
- Admission
      to the Kenyan Bar with a valid practicing certificate from the Law
      Society of Kenya (LSK).
- Experience:
- Minimum
      of 5 years in commercial and conveyancing law in Kenya, with at least 2
      years in a Kenyan banking environment.
- Technical
     Expertise:
- Proficiency
      in Kenyan property law, banking regulations, and contract law.
- Strong
      understanding of financial regulatory frameworks, including the Banking
      Act and Central Bank of Kenya (CBK) guidelines.
- Soft
     Skills:
- Exceptional
      negotiation, draughting, and problem-solving skills.
- High attention to detail and ability to manage complex transactions.
- Strong communication and interpersonal skills for client and stakeholder management.
Responsibilities
- Commercial Law
- Draft, review and negotiate contracts, agreements, and other legal documents for Kenyan commercial transactions.
- Provide legal advice to ensure compliance with Kenyan commercial and banking regulations.
- Conveyancing
- Manage property transactions, including title searches, sale agreements, and property transfers in Kenya.
- Ensure timely registration of leases, charges, and mortgages with Kenyan authorities, including the Lands Registry.
- Banking and Financial Legal Support
- Draft and review loan agreements, securities, and collateral documents in compliance with the Central Bank's regulations.
- Support banking operations through advisory services on credit approvals, debt recovery, and foreclosure processes.
- Regulatory Compliance and Risk Management
- Identify and mitigate legal risks in all commercial and conveyancing matters in line with Kenyan law.
- Ensure adherence to Kenya’s property and banking regulatory standards.
- Client and Stakeholder Engagement
- Liaise with Kenyan banks, clients, and stakeholders to facilitate seamless transaction execution.
- Represent clients in negotiations and alternative dispute resolution settings where necessary.
- Research and Legal Advisory Services
- Provide expert legal opinions on Kenyan property and financial laws.
- Stay updated on changes in Kenyan laws and regulations affecting commercial and conveyancing practices.
- Capacity Building
- Mentor junior legal staff on conveyancing and commercial law practices specific to Kenya.
- Conduct internal training on relevant legal topics.
