Description
The Civil and Commercial Litigation Lawyer will handle complex legal disputes, including civil litigation, commercial litigation, and alternative dispute resolution (ADR) processes. The role involves representing clients in Kenyan courts and tribunals, advising on commercial contracts, and resolving disputes through litigation, or ADR. The lawyer will also provide guidance on risk management and compliance, ensuring alignment with Kenyan laws and international standards where applicable.
Requirements
- Education:
- Bachelor
of Laws (LLB) degree from a recognised university in Kenya.
- Admission
to the Kenyan Bar with a valid practicing certificate from the Law
Society of Kenya (LSK).
- Experience:
- Minimum
of 5 years in civil and commercial litigation and arbitration, with a
proven track record in Kenyan courts.
- Strong
experience in arbitration and ADR processes, including drafting
agreements and managing proceedings.
- Technical
Expertise:
- Deep
knowledge of Kenyan civil procedure rules, commercial laws, and
arbitration practices.
- Familiarity
with local and international arbitration rules (e.g., CIArb, UNCITRAL).
- Proficiency
in legal draughting, research, and litigation management.
- Soft
Skills:
- Strong
analytical, negotiation, and problem-solving skills.
- Excellent
written and verbal communication skills.
- Ability
to manage multiple cases and meet tight deadlines.
- Education:
Responsibilities
- Civil
and Commercial Litigation
- Represent
clients in Kenyan courts, including High Court, Court of Appeal, and
tribunals, for civil and commercial disputes.
- Draft
and file pleadings, affidavits, submissions, and related legal documents.
- Develop
and execute litigation strategies to achieve favourable outcomes for
clients.
- Arbitration
and Alternative Dispute Resolution (ADR)
- Represent
clients in arbitration proceedings under Kenyan and international rules
(e.g., CIArb, UNCITRAL).
- Draft
arbitration agreements and submissions
- Facilitate
mediation and negotiation processes to achieve amicable settlements.
- Legal
Advisory and Risk Management
- Advise
clients on Kenyan commercial law, contract law, and civil obligations.
- Provide
legal opinions and strategies to minimise litigation risks and resolve
disputes efficiently.
- Assist
clients in interpreting and complying with Kenyan legal requirements,
including regulatory frameworks.
- Contract
Review and Drafting
- Review
and draft commercial contracts, including joint ventures, lease
agreements, and service agreements.
- Negotiate
terms and conditions to protect client interests and minimise potential
disputes.
- Client
and Stakeholder Engagement
- Liaise
with clients, courts, and stakeholders to ensure seamless case management
and resolution.
- Build
and maintain relationships with clients to enhance trust and repeat
engagement.
- Legal
Research and Development
- Conduct
thorough research on Kenyan laws, legal precedents, and arbitration
standards.
- Stay
updated on developments in litigation, ADR, and legal technology trends
in Kenya.
- Team
Collaboration and Capacity Building
- Mentor
junior lawyers and legal interns on litigation and arbitration best
practices.
- Contribute
to knowledge sharing within the legal department to strengthen overall
capacity.
